When is translation mandatory?

If your supporting documents (such as police certificates, academic degrees, or birth certificates) are in Spanish or any other language that is not English or French, it is mandatory to include an official translation. Documents in their original language will not be accepted without their respective translated version, which could lead to the rejection of the application due to incomplete documentation.

Elements Required by the IRCC

For a translation to be considered valid by immigration authorities, the file must contain three inseparable elements:

• The Translation: It must be a faithful and complete version of the original document, including stamps, signatures, and marginal notes.

• Affidavit: This is a document signed by the translator in the presence of an authorized authority (such as a notary or commissioner of oaths), attesting that the translation is an accurate representation of the original and that the translator possesses the necessary linguistic competence.

• Certified Copy of the Original: You must include a photocopy of the original document that has been certified by a competent authority, confirming it is a true copy of the authentic document.

Exemption from the Apostille

A frequent point of confusion among applicants is the need for the Hague Apostille. For immigration processes managed by the IRCC, the Apostille is not required on translations or original documents. The Canadian system relies on the translator's certification and the affidavit, simplifying this international procedure.

Logistical Recommendations

It is recommended to manage these translations well in advance of the start of the season.
